Rep. Pramila Jayapal didn’t hold back when Homeland Security Secretary Kristi Noem showed up before Congress — and what followed was a devastating takedown that exposed just how far the Trump administration has pushed the limits of the Constitution.
Jayapal began with a simple question: “Do you know what the Fourth Amendment says?”
Noem stumbled through a vague answer about “search and seizure processes,” prompting Jayapal to spell it out: the Constitution protects Americans from unreasonable searches and seizures by their own government.
And that’s exactly what Jayapal says Noem’s Department of Homeland Security is violating. During the hearing, Jayapal revealed that ICE has detained U.S. citizens who committed no crime — and she brought four of them into the room to prove it.
One woman had pepper spray blasted into her car before ICE agents smashed her windows and dragged her out. Another man was pulled from his vehicle and placed in leg irons after simply observing ICE activity. A peaceful protester was shot with a pepper ball and denied medical treatment. And a U.S. Marine Corps veteran had guns drawn on him before being detained for hours.
None of them were charged with a crime. None were even asked to prove their citizenship. All were exercising their First Amendment rights.
When Jayapal asked them to raise their hands if they had been charged with anything, not a single hand went up.
That’s when the congresswoman delivered the knockout blow.
“DHS is supposed to protect our residents and uphold constitutional protections,” Jayapal said. “But you’ve turned the United States government against its own residents.”
She then called for Noem to resign, be fired, or be impeached.
And Jayapal doubled down afterward in a television interview, warning that Noem’s tenure may already be on borrowed time. According to the Washington Democrat, the lawlessness unfolding under Noem’s watch — including Americans being detained, injured, and even killed — is destroying public trust.
“She does not have a long career here,” Jayapal said bluntly.
