Fala upałów i praca: robotnik ginie na placu budowy, liczba zgonów rośnie każdego lata
W obliczu kolejnej fali ekstremalnych upałów we Francji, tragicznie potwierdziły się zagrożenia dla zdrowia pracowników, zwłaszcza w budownictwie i rolnictwie.
W poniedziałek, 1 lipca, 35-letni robotnik budowlany zmarł w Besançon na udar mózgu, krótko po opuszczeniu miejsca pracy.
Od rana narzekał na upał.
Ta tragedia jest kolejnym przykładem na i tak już długiej liście: od 2018 roku co najmniej 48 pracowników straciło życie w wypadkach przy pracy związanych z ekstremalnymi upałami .
A liczba ta może być znacznie niższa od rzeczywistej.
Niepokojące liczby… i niedoszacowane
Według Public Health France w 2024 roku odnotowano siedem śmiertelnych wypadków przy pracy, prawdopodobnie związanych z upałami . W większości przypadków ofiarami byli mężczyźni pracujący w sektorze budowlanym lub rolnym, najbardziej narażeni na ekstremalne temperatury.
W 2023 roku było ich 11, a od 2018 roku łączna liczba wzrosła do 48. Jednak ta oficjalna liczba nie odzwierciedla w pełni sytuacji.
Według Guillaume’a Boulangera, specjalisty z Public Health France:
Trudność wynika częściowo z metody raportowania: inspektorzy pracy zgłaszają przypadki za pomocą specjalnych formularzy. Jednak te służby są często przeciążone, a związek między upałem a śmiercią nie zawsze jest łatwy do ustalenia , zwłaszcza gdy objawy pojawiają się kilka dni po narażeniu.
Prawo pracy pozostaje niejasne w obliczu fali upałów
W branży budowlanej ekstremalne upały mogą prowadzić do tymczasowych zwolnień już po ogłoszeniu pomarańczowego lub czerwonego alertu. Jednak w innych sektorach Kodeks pracy nie określa maksymalnej temperatury .
Jedyne dostępne rozwiązanie dla pracowników? Prawo do odstąpienia od pracy , jeśli uważają, że narażeni są na poważne i bezpośrednie zagrożenie zdrowia. Muszą jednak być w stanie udowodnić, że ryzyko istniało realnie… i przekonać sędziego w razie sporu.
Co powinni zrobić pracodawcy?
Od 1 lipca 2025 roku nowe rozporządzenie nakłada na pracodawców obowiązek podjęcia konkretnych działań w celu ochrony pracowników podczas fali upałów. Wśród wprowadzonych środków znajdują się:
